    SUCCESSOR TRUSTEE’S NOTICE OF SALE

Sale at public auction will be on January 29, 2014, at 11:00 A.M., at the Main Entrance of the Polk County Courthouse, Benton, Tennessee, pursuant to a Deed of Trust executed by Timothy R. Kaylor and Angela D. Kaylor to Douglas R. Johnson, Trustee for the beneficial interest of Appalachian Community Bank, FSB, at Trust Book 380, Page 209, in the Register’s Office of Polk County, Tennessee, as assigned to Brightbridge, Inc. on September 30, 2013, and conducted by Harry R. Cash, Successor Trustee or his designated agent, all of record in the Polk County Register’s Office.

The following real estate located in Polk County, Tennessee will be sold to the highest cash bidder subject to all unpaid taxes, prior liens and encumbrances of record:
A certain tract or parcel of land lying and being in Section 9, Fractional Township 4 South, Range 5 East of the Ocoee Basis Line, Copper Basin Industrial Park, Third Civil District of Polk County, Tennessee and being more particularly described as follows:
BEGINNING at an iron pin set at the Southwest corner of the property herein conveyed, said pin being on the north right-of-way of a paved access road to the Sewage Treatment Plant, said right-of-way being fifty (50) feet along said paved road, said point of beginning also being located North 87° 04’ 50” East a distance of 33.03 feet from a sewer manhole in said right-of-way.  From said point of beginning, leaving the aforementioned right-of-way and along the centerline of a 50-foot wide easement for a future roadway North 06° 18’ 16” East a distance of 168.69 feet to an iron pin set.  Thence leaving the centerline of the future roadway and along a line common to Copper Basin Industrial Park North 55° 02’ 49” East a distance of 431.07 feet to an iron pin set; thence North 62° 36’ 14” East a distance of 65.45 feet to an iron pin set on the Northeast corner of the property herein conveyed and corner common to Pitman Superior Medical.  Thence leaving the line common to Copper Basin Industrial Park and along a line common to Pitman South 18° 20’ 07” East a distance of 23.86 feet to the centerline of a 24’ wide ingress-egress easement to Industrial Park Drive.  Thence continuing South 18° 20’ 07” East a distance of 26.31 feet to an iron pin found.  Thence continuing South 18° 20’ 07” East  a distance of 265.46 feet to an iron pin found at the Southeast corner of the property herein conveyed and corner common to Pitman and Copper Basin Industrial Park.  Thence leaving the line common to Pitman and along a line common to Copper Basin Industrial Park South 65° 13’ 37” West a distance of 204.67 feet to an iron pin set at the top of a bank; thence South 51° 56’ 31” West a distance of 225.66 feet to an iron pin set on the North right-of-way margin of the aforementioned paved road.  Thence leaving the line common to the Copper Basin Industrial Park and along the aforementioned right-of-way the following three calls and distances:  North 55° 16’ 00” West a distance of 74.48 feet to an iron pin; thence in a right hand curve a distance of 78.02 feet subtended by a chord North 67° 19’ 34” West a distance of 77.78 feet; radius = 284.70 feet to an iron pin; thence North 77° 23’ 59” West a distance of 33.55 feet to the point of beginning.  Containing 3.37 acres, more or less, as surveyed by Allen Surveying, Tennessee Registered Land Surveyor No. 1530, HCR 64, Box 412, Farner, Tennessee 37333 and shown on boundary survey for Copper Basin Industrial Authority, dated May, 1995, said survey being recorded in Plat Book 7, Page 131, in the Register of Deeds Office, Polk County, Tennessee and incorporated herein for further description.
Bounded on the North by Copper Basin Industrial Park, on the East by Pitman Superior Medical, on the South by Copper Basin Industrial Park and Access Road, and on the West by Copper Basin Industrial Park.
For prior title, see deed recorded in Deed Book 280, Page 13, and re-recorded in Deed Book 280, Page 32, in the Register’s Office of Polk County, Tennessee.

The above-described property is subject to the following restrictions:

1.    Polk County, Tennessee, a political subdivision of the State of Tennessee, and the Copper Basin Industrial Board, a governing Board of the Copper Basin Industrial Park hereby reserve the right to inspect and approve of additional buildings and improvements to said property.

2.    The site shall be kept neat and in a workmanlike order and in appearance.  See unanimously approved Motion of Polk County Commission, dated April 20, 1995 authorizing the sale of the aforementioned property and giving Hoyt T. Firestone, County Executive, authority to convey the within described property.
