NOTICE OF TRUSTEE'S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 19, 2007, and the Deed of Trust of even date securing the same, recorded March 29, 2007, at Book TD354, Page 449 in Office of the Register of Deeds for Polk County, Tennessee, executed by Teresa J. Gombash and Kelvin M. Gombash, conveying certain property therein described to EquiTitle, Inc. as Trustee for Mortgage Electronic Registration Systems, Inc., as a separate corporation that is acting solely as a nominee for First American Equity Corp. and First American Equity Corp.'s successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on December 2, 2013 on or about 1:00 P.M., at the Polk County Courthouse, Benton, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Polk County, Tennessee, and being more particularly described as follows:
Located in the First Civil District of Polk County, Tennessee:
Lot 5, Chilhowee Estates, as shown by plat of record in Plat Book 8, Page 280, in the Registers Office of Polk County, Tennessee.
ALSO KNOWN AS: 141 Burgess Drive, Benton, Tennessee 37307
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property: Teresa J. Gombash; Kelvin M. Gombash
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. It appearing from the Complaint in this cause, which is sworn to, that the Defendant, DANIEL NEWTON HUGHES’ residence may still be within the State of Tennessee; and it further appearing that his exact whereabouts are unknown so that ordinary process cannot be served upon him.
It is therefore ordered that said Defendant, DANIEL NEWTON HUGHES, will appear and make defense within thirty (30) days of the Complaint, or the same will be taken for confessed as to default and set for hearing ex parte, and that a copy of this order be published for four consecutive weeks in the POLK COUNTY NEWS, a newspaper in Benton, Tennessee.
Within that time Defendant is also required to serve a copy of his pleadings upon M. SUSIE STARNES, Plaintiff’s Attorney whose address is 223 Harle Avenue NW, Cleveland, Tennessee 37311.
