TRUSTEE’S NOTICE OF FORECLOSURE SALE

WHEREAS, by Trust Deed dated the 5th day of May, 2006, Kimberly Watkins did convey in trust certain land described to secure the original principal amount of Fifty-Two Thousand, Seven Hundred Forty-One and 35/100 Dollars ($) as evidenced by a promissory note duly incorporated in said Deed of Trust by reference and said Deed of Trust was duly recorded on May 9, 2006 in Trust Deed Book 335, pages 398-402 in the Register of Deeds Office, Polk County, Tennessee, said Deed of Trust and Promissory Note made payable to Appalachian Community Bank n/k/a Peoples Bank of East Tennessee.
WHEREAS, said Deed of Trust provided that in the event of the default in payment of any installment of said Note, the entire indebtedness shall at the option of the owner and holder of said note has declared the entire balance thereof due and payable and has instructed the undersigned Trustee to foreclose on said Deed of Trust;

Being the same property conveyed to Kimberly Watkins by warranty deed from Joyce Brendle recorded on May 9, 2006 in Warranty Deed Book 244, pages 158-159 in the Register of Deeds Office, Polk County, Tennessee.
Said Deed of Trust recites title to said real estate as encumbered, except as aforesaid, but the sale will be made as Trustee only, without covenants of warranty or seisin, and subject to any unpaid State, County and City taxes and other assessments or other liens, easements or restrictions.
The Trustee, at the instructions of the beneficiary of the Deed of Trust, shall have the power to adjourn the foreclosure sale to a day, time and place certain, upon announcement at the time and place for the sale set forth above.  The Trustee need not personally attend or conduct the sale and may, at her option, cause the sale to be conducted by an agent or attorney selected by her.  It is further agreed that the Trustee or any mortgagee or beneficiary may bid in case of foreclosure sale.

It is the duty of your Grand Jurors to investigate any public offense which they know or have reason to believe has been committed and which is triable or indictable in this county. Any person having knowledge or proof that such an offense has been committed may apply to testify before the Grand Jury subject to the provisions of TCA, Section 40-12-104.

You may be prosecuted for perjury for any oral or written statement which you make under oath to the Grand Jury, when you know the statement to be false, and when the statement touches on a matter material to the point in question.

Notice of a Finding of No Significant Impact
The USDA, Rural Utilities Service has received an application for financial assistance from the Town of Benton. The proposal consists of development and construction of a second well to provide needed backup of the Town of Benton’s water system and provide equipment upgrades at the existing water treatment plant.  Possible locations for the well are within 1,500 feet of the existing water treatment plant located on Betty Stephens Road, east of the Town of Benton.  Construction will include installation of a waterline from the new well to the water treatment plant. Mitigation measures include silt fencing, straw bales, erosion control fabric, and similar erosion control techniques to prevent soil migration from excavations.  The alternatives considered to the proposal included: finding a new water source on either the Ocoee or Hiwassee Rivers and construction of a new surface water treatment plant.  The environmental effects and costs of the alternative were considerably greater than the proposed activity and was therefore not selected.
As required by the National Environmental Policy Act and agency regulations, the Rural Utilities Service prepared an Environmental Assessment of the proposal that assessed the potential environmental effects of the proposal and the effect of the proposal may have on historic properties. The Environmental Assessment was published on August 15 and 22, 2012 for a 30-day public comment period.  No comments were received.  Upon consideration of the applicant’s proposal, federal and state environmental regulatory and natural resource agencies, and public input the agency has determined that the proposal will not have a significant effect on the human environment and for which an Environment Impact Statement will not be prepared.
