NOW, THEREFORE, by virtue of the authority vested in me as Substitute Trustee under the terms of said instrument, I, the undersigned will on the 8th day of June, 2012 at 10:15 a.m. EST in front of the West Door of the Ducktown Law Court, Ducktown, Tennessee, offer for sale and sell to the highest and best bidder for cash in hand and in bar of the equities of redemption, dower and homestead, the following described real estate known as 761 Ocoee Street, Copperhill, Polk County, Tennessee, to wit:
A certain tract of land situated in Sections 21 and 22 Fractional Township 4 South Range  5 East of the Ocoee Basis Line in the Third Civil District of Polk County, Tennessee and being more particularly described as follows:  BEGINNING at an iron pin located South 31º 49’ West 276.15 feet from a corner common to Section 16, 15, 21 and 22; said point of beginning being the Northwest corner of the property herein conveyed; from said point of beginning South 87º 30’ East 281.28 feet; thence South 12º 31’ West 465.0 feet to an iron pin; thence South 31º 38’ West 35.47 feet to an iron pin located on the North right of way of Grassy Creek Road, said right of way being 60 feet total width, 30 feet from the centerline; thence along with said right of way North 87º 28’ West 220.0 feet to an iron pin; thence leaving said right of way North 02º 06’ East 272.15 feet to an iron pin; thence North 12º 31’ East 220.0 feet to the point of beginning, containing 3.0 acres, more or less as surveyed by Phillip G. Allen, Registered Land Surveyor, Tennessee No. 1503, HCR 64 Box 412, Farner, Tennessee 37333. Said survey and plat made a part of this description and hereby incorporated by reference. See Plat Book 12, page 80.
Subject to the reservation of oil, gas, hydrocarbons by the Cities Service Company by deed of record in deed book 108, page 289 in the Register of Deeds Office, Polk County, Tennessee.
Subject to any governmental zoning and subdivision ordinances or regulations in effect thereon.
Subject to existing easements and right of ways for public roads, if any.  Also subject to Polk County,  Tennessee subdivision regulations.
Being the same property conveyed to Roger B. Hyatt and wife, Treva A. Hyatt by Deed of Assumption from James M. Stillwell and wife, Karen Stillwell and James Euclid Stillwell recorded on November 18, 1995 in Warranty Deed Book 184, pages 6-8 in the Register of Deeds Office, Polk County, Tennessee.
LESS AND EXCEPT 0.63 acres conveyed to Copper Basin Federal Credit Union by Warranty Deed recorded in Warranty Deed Book 186, pages 85-88 in the Register of Deeds Office, Polk County, Tennessee.  Said conveyance incorporated the 0.37 acres conveyed by Warranty Deed recorded in Warranty Deed Book 184, page 154 and added additional acreage for the purpose of extinguishing all prior easements set forth in the prior conveyance.  Both conveyances were made subject to the restriction that Grantors therein, their successors, heirs and assigns will not construct any building or improvement closer than twenty (20) feet to any of the property lines of Copper Basin Federal Credit Union and that the Grantors therein, their successors, heirs and assigns shall not construct any improvement which shall obstruct the view of the Copper Basin Federal Credit Union, which said restrictions are perpetual and a burden running with the lands of the Grantor therein.
Said Deed of Trust recites title to said real estate as encumbered, except as aforesaid, but the sale will be made as Trustee only, without covenants of warranty or seisin, and subject to any unpaid State, County and City taxes and other assessments or other liens, easements or restrictions.
The Trustee, at the instructions of the beneficiary of the Deed of Trust, shall have the power to adjourn the foreclosure sale to a day, time and place certain, upon announcement at the time and place for the sale set forth above.  The Trustee need not personally attend or conduct the sale and may, at her option, cause the sale to be conducted by an agent or attorney selected by her.  It is further agreed that the Trustee or any mortgagee or beneficiary may bid in case of foreclosure sale.
This is an attempt to collect a debt and any information obtained will be used for that purpose.
This Notice shall appear in the Polk County News, a newspaper published in Polk County, Tennessee on May 23, May 30 and June 6, 2012.
