County Attorney Jimmy Logan has been targeted for allegedly filing a fraudulent claim in the bankruptcy case of Mark Anderson. Anderson filed for bankruptcy after receiving a foreclosure notice from Anderson Partners, which was formed with Logan’s help after Anderson won $1.2 million in the Georgia Lottery in 2000. The U.S. Bankruptcy Court in March dismissed three claims by Anderson Partners, which would have been the major debts in the bankruptcy.
In a Complaint filed at the end of October, Anderson is seeking actual and punitive damages from Logan, citing a fraudulent claim. It notes that sworn proof of claims were filed by Logan on behalf of Anderson Partners -- $164,352 for a mortgage, $114,999 on a promissory note, and $49,316 for a promissory note for a truck. The Complaint states that Logan knew that Anderson Partners was an entity that never legally existed. It pointed out the Court ruled that Anderson contributed all or a substantial portion of the lottery winnings to the partnership so he would be the only partner who would receive any benefit from the repayment of the partnership debt.
The court filing goes on to say that Logan “is attempting by fraud, deceit and abuse of the bankruptcy process to receive disbursements from the property of the debtors’ estate in bankruptcy to repay himself for monies advanced to debtor’s ex-wife for child support.” It alleges that Logan has filed a false claim as a device to perpetuate a fraud upon the court, the Chapter 13 trustee, the scheduled creditors and the debtor. It alleges that the actions constitute harassment, saying Anderson has been damaged by having to continue to spend time and money toward the defense of the contested matter to protect his rights.
Anderson is asking the court to impost sanctions on Logan for attempting to file an improper claim, to avoid the liens on which Logan’s proof of claims are based, to award punitive damages and legal fees to Anderson and to award an additional non-base legal fee of $2,500 to Jeff Miller (Anderson’s attorney) for filing the complaint as well as reasonable attorney’s fees.
