SUBSTITUTE TRUSTEE'S SALE

 

WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust executed on March 15, 2007, by William Hancock II and Victoria Hancock to PRLAP, Inc., Trustee, as same appears of record in the Register's Office of Polk County, Tennessee, under Book No. TD364, Page 393, ("Deed of Trust"); and

WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to BANK OF AMERICA, N.A.; and

WHEREAS, BANK OF AMERICA, N.A., the current owner and holder of said Deed of Trust, (the "Owner and Holder"), appointed the undersigned, Nationwide Trustee Services, Inc., as Substitute Trustee by instrument filed for record in the Register's Office of Polk County, Tennessee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Owner and Holder, and that the undersigned, Nationwide Trustee Services, Inc., Substitute Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him, will on Thursday, March 4, 2010, commencing at 2:00 PM at the Front steps on Ocoee Street of the Polk County Courthouse, Benton, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Polk County, Tennessee, to wit: Real property situated, lying and being in the Third Civil District, County of Polk, State of Tennessee, to-wit Beginning in the Northeast line of Chanceytown Road, where the same intersected by the Southeast line of an unnamed paved road, which beginning point is approximately 2006 feet east from the east line of Tennessee Highway 68, and North across the road from the school property and East across the road from Hensley, and running thence with said line of Chanceytown Road, South 73 degrees 15 minutes East 128 feet to the Northwest line of land of Presswood; thence with said line of Presswood, North 16 degrees 05 minutes East, 121 feet to the southwest line of Dilbeck and at an iron pin; thence with said line of Dilbeck, North 71 degrees 20 minutes West 133 feet to the Southeast line of said second mentioned paved unnamed road thence with said line of said road, South 12 degrees 45 minutes West, 114 feet to the beginning and containing 0.34 acres as shown by survey of Otis Gibson dated November 1976.

This being the same land conveyed by Francis M. Panter and Audra J. Panter to Robert M. Nicholson and Jewel K Nicholson by warranty deed dated September 9, 1977, recorded in Book 90, Page 375, Polk County records.

The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose.

SUBORDINATE LIENHOLDERS: N/A OTHER INTERESTED PARTIES: N/A All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. It is the duty of your Grand Jurors to investigate any public offense which they know or have reason to believe has been committed and which is triable or indictable in this county. The Grand Jury will next meet at the Benton Courthouse on Monday, the 1st day of March, 2009 at 9:00 A.M. and at the Ducktown Courthouse on the 1st day of March, 2009 at 1:00 P.M. You may be prosecuted for perjury for any oral or written statement which you make under oath to the Grand Jury, when you know the statement to be false, and when the statement touches on a matter material to the point in question.

The foreman for the Benton area is Steve Harbison, and the foreman for the Ducktown area is Roger Thomasson.
