SCOGGINS and wife, BEVERLY SCOGGINS did convey in trust certain land therein described to secure a Promissory Note duly incorporated in said Trust Deed to PEOPLES BANK OF POLK COUNTY by reference and said Trust Deed was duly recorded in the Register's Office of Polk County, Tennessee, in Trust Book 301, page 657;              WHEREAS, said Trust Deed provides that in the event of the default in the payment of any installment of said Note for a period of thirty (30) days, the entire indebtedness shall, at the option of the owner and holder thereof, become due and payable; and

WHEREAS, default has been made in the payment thereof and the owner and holder of said Note has declared the entire balance thereof due and payable and has instructed the undersigned Trustee to foreclose said Trust Deed.

NOW, THEREFORE, by virtue of the authority in me vested as  Trustee under the terms of said instrument, I, the undersigned, will on the 26th day of September, 2008, at 10:00 o'clock A.M., in front of the West  Door of the Courthouse in Polk County, Tennessee, offer for sale and sell to the last, highest and best bidder, for cash in hand, and in bar of the equities of redemption, dower and homestead, the following described real estate, lying and being in the 1st Civil District of Polk County, Tennessee, to-wit:

BEING LOTS 1C, 1B, and 1D of LITTLE DOODLE ACRES as shown by plat of record in Plat Book 9, page 107, Register’s Office of Polk County, Tennessee to which reference is herein made.

Lot 1C and 1D are conveyed subject to a 20' overhead utility line easement.  

All lots are conveyed Subject to one-half of a 50' road right-of-way easement leading Easterly from Reynolds Bridge Road as shown on said plat.  Said right-of-way easement is a joint driveway easement and is to be maintained on a pro rata basis by all owners sharing in the use of said right-of-way.  Said road is not a public road and is not to be maintained by Polk County, Tennessee.

Being the property acquired by Edward and Beverly Scoggins in Deed Book 230, page 254, ROPCT.

Said lots are conveyed subject to the restrictive covenants and conditions set out in Deed Book 228, page 72, ROPCT.

Said lots are conveyed subject to building setbacks of front-35'; side-10'; rear-15'.

Said lots are conveyed subject to a 20' drainage and utility easement along street lines; 10' along exterior lines of the subdivision; and 5' along interior lot lines.

Being Tax Map No. 55 Parcel 1.16; Map 55 Parcel 1.17 and Map 55 Parcel 1.18.

The street address(es) is believed to be .115 Hidden View Cove, 125 Hidden View Cove and 106 Hidden View Cove, Benton, TN.

OTHER INTERESTED PARTY(IES):  None of record.

The title to said real estate is believed good, but I will convey as Trustee only and subject to any unpaid taxes.

This sale is subject to all matters shown on applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.

The sale held pursuant to this Notice may be rescinded at the Trustee/Successor Trustee=s option at any time.  The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
