Criminal Court was held in Benton last week, with indictments handed down and pleas entered. An indictment is not a finding of guilt but an indication there is enough evidence to proceed to trial.

Davis Bradley Waldroup Jr. was re-indicted on charges in connection with the October, 2006, attack on his estranged wife and the murder of her friend at his home on Kimsey Mountain. According to Assistant District Attorney General Drew Robinson, the kidnapping charges regarding his children, who were at his home, were dismissed and a felony murder charge was added to the first degree and attempted first degree murder charges. Robinson said his office intends to seek the death penalty. The trial will probably be in mid-2009, he said.

James Payne, two counts possession of meth for resale, two counts possession drug paraphernalia, possession of a firearm, simple possession marijuana, possession Schedule IV drug.

Eric Roberson, 5th offense DUI, 3rd offense driving on revoked license, evading arrest, domestic assault, criminal impersonation.

Viola Swan, sale/delivery of Schedule II drug.

Donald VanDoozer, public intoxication, obstruction highway/passageway, disorderly conduct.

Brian Bears, possession crack cocaine for resale, possession drug paraphernalia, simple possession marijuana, contributing to b delinquency of a minor.

Jacob Boswell, three counts burglary, aggravated assault, three counts vandalism, escape, two counts aggravated burglary, resisting arrest, five counts aggravated assault.

Kenneth Campbell, initiating the process of manufacturing meth, possession of marijuana, driving on suspended license.

David Cross, unlawful possession of a weapon, simple possession marijuana, possession drug paraphernalia, possession Schedule III drug.

Jeremy Cross, domestic assault.

Crystal Ellison, burglary.

Joshua Huckeba, burglary, theft over $10,000, burglary, forgery

Patricia Hill, introduction contraband into a penal facility.

Rickey Johnson, sale and delivery of Schedule III drug, sale/delivery Schedule VI drug.

Shawn Jones, 28 counts forgery, two counts fraudulent use of a credit card.

Jeffrey Lawson, evading arrest, driving on revoked, resisting arrest.

Patrick McDaniel, initiating process of manufacturing meth, possession marijuana, resisting arrest.

Brenda Montkahaus, sale/deliver of Schedule VI and Schedule III drug.

Darrell Montkahaus, sale/delivery of Schedule VI and Schedule III drug.

Steve Morgan, assault, two counts driving on suspended license, two counts disorderly conduct, two counts resisting arrest, vandalism, assault.

Kevin O’Neal, 4th offense DUI, open container.

Charles Price, burglary, theft of property, vandalism, registration violation, driving on suspended license.

Court dispositions

Robin Beard, 41, assault. Nolle. Resisting arrest, nolle

Robin Beard (Coalson), violation of probation. To serve 60 days.

Jeremy S. Dixon, 26, aggravated robbery. 12 months concurrent. Two counts aggravated assault, 6 years concurrent.

David Jeff Danley, violation of probation. Ten days, to be released on enhanced probation.

Yvonne Baliles, violation of probation. To serve 11 months, 29 days @ 75%.

William Poyner, violation of probation on charge of burglary by new arrest, failure to report arrest, failure to inform officer of travel outside state. To serve 4 years; court recommends boot camp.

Ryan Keith Walden, 20, theft. 5 years, reduced to probation, to pay $10,000 restitution, then court costs. Criminal trespass, 30 days reduced to probation, to pay costs. Burglary, 3 years reduced to probation, to pay costs.

Blake K. Wondergem, 48, 3 counts Sale, loan or exhibition of material to minors, nolle.

Chris Messer, 40, driving on suspended license. 11 months/29 days reduced to probation after 48 hours, $250 fine and costs. Simple possession of meth, 11-29 reduced to probation, $750 fine and costs. Possession drug paraphernalia, dismissed.

Ashley Dawn Hohlt, 26, introducing contraband in a penal facility. 3 years, reduced to probation after 6 months consecutive to violation of probation time, $350 fine and costs.

Steve Bramlett, 29, vehicular assault. 4 years, lose license for one year, to pay costs. Boot camp recommended.

Kevin O’Neal, 37, 4th offense DUI. 1 year, reduced to probation after 150 days, $3,000 fine and costs, lose license for 4 years. Open container, dismissed.

Mikel L. Herron, violation of probation on a charge of drug paraphernalia by new arrest, drugs in possession, failure to complete DNA test. To serve 2 years.

Ashley D. Hohlt, violation of probation on charge of robbery, accessory, burglary by new arrests, possession of drugs, failure to ay. To serve 3 years; reinstate after 6 months.

Jeffrey D. Lawson, 25, evading arrest. To serve 1 year, $500 fine and costs. 3rd offense driving on revoked license, 11/29 reduced to probation after 45 days, $250 fine and costs. Resisting stop, dismissed.

Michael A. Eaton, violation of probation on charge of aggravated burglary and theft by new misdemeanor convictions. To serve 4 years.
