PUBLIC NOTICE
The Individual’s With Disabilities Education Act Amendments of 1997 (IDEA) were enacted into as Public Law 105-17 by Congress in June 1997. This law includes amendments that do have an effect on the special education services Local Education Agencies (LEA) provide for students whose parents have enrolled them in private or home school programs. As an LEA, Polk County Schools is still required under IDEA to include those students residing in our areas, who are attending private or home schools, in their Child Find efforts and special education services. The purpose of Child Find is to identify all students with disabilities who may be in need of special education services.
It is important for Polk County Schools to determine the current group of eligible private and home school students so that decisions can be made as to the types and amounts of special education services that will be provided for this population. Students in private or home schools are only eligible for a proportionate amount of the Federal funds provided for the education of students with disabilities. Polk County Schools has scheduled a meeting to further explain services available for these children. This meeting will be held at the Polk County Board of Education, located at 131 Stephens, St. Benton, TN The meeting will be August 15, 2008 at 2:00 p.m.

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated July 22, 2005, and the Deed of Trust of even date securing the same, recorded August 2, 2005, at Book 323, Page 357 in Office of the Register of Deeds for Polk County, Tennessee, executed by Diane Stiles, conveying certain property therein described to C. Thomas Cates as Trustee for America's Moneyline Inc.; and the undersigned, Shellie Wallace of Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.

A certain tract of land, situated in Sections 15 and 22, Fractional Township 3, South Range Five, east of the Ocoee Basis Line in the Third Civil District of Polk County, City of Turtletown and State of Tennessee, being located on Stansbury Road and being more particularly described as follows: Beginning at a point located on the northwest corner of the property herein conveyed, said point of beginning being a corner common to the south right of way of 18 foot asphalt road, known as Stansbury Road said right of way being 30 feet from the centerline, and the east right of way of 12 foot gravel road, said right of way being 30 feet mentioned (15 feet from the centerline) said point of beginning being located south 74 degrees 27 minutes 50 seconds east a distance of 61.96 feet from the southeast corner of concrete box culvert, from said point of beginning, leaving with of way of said gravel road and along with the south right of way of Stansbury Road, south 86 degrees 10 minutes 08 seconds east a distance of 135.02 feet to an iron pin and corner common to the property herein conveyed, said right of way and other property of Ray Hughes, thence leaving said right of way and along with Hughes property, south 13 degrees 43 minutes 52 seconds east a distance of 290.19 feet to an iron pin, thence north 78 degrees 30 minutes 16 seconds west a distance of 189.12 feet to an iron pin located on the aforementioned east right of way of 12 foot gravel road, thence leaving Hughes property line and along with said right of way the following two calls and distances: North 08 degrees 44 minutes 22 seconds west a distance of 150.30 feet, thence north 02 degrees 29 minutes 30 seconds east a distance of 104.76 feet to the point of beginning, containing 1.0 acres, more or less as surveyed by Phillip G. Allen, Registered Land Surveyor, Tennessee No. 1530, and shown on Plat of Survey dated September, 1988 a copy of which is attached to said Deed for a more complete description and hereby incorporated by reference.
