that certain Deed of Trust executed on April 25, 2007 by Rebecca Ann Womble to James A. Elrod, as same appears of record in the Register’s Office of Polk County, Tennessee, under Book No. TD 357, Page 77-83, (“Deed of Trust”); and

Bishop, R.L.S. No. 1324, prepared for James A. Elrod, said plat of survey being dated March 27, 2006 and being recorded in Plat Book 11, Page 112, Polk County Deed records.  Said plat of survey is incorporated herein by reference thereto for a more complete and accurate metes and bounds description of the above-described property.  

Being a portion of that property conveyed from James A. Elrod and wife, Lena Elrod to Linda Elrod Jones by Warranty Deed dated May 9, 2002, recorded in Deed Book 223, Pages 454-55, Polk County Deed records.

Being a portion of that property conveyed from Linda Elrod Jones to James A. Elrod by Warranty Deed dated March 2, 2007, recorded in Deed Book 249, Pages 459-460, Polk County Deed records.

Subject to all easements, restrictions and rights of way as shown on that plat of survey recorded in Plat Book 11, Page 112, Polk County Deed records.

TRUSTEE'S SALE

 

WHEREAS, by Trust Deed dated the 1st day of December, 2005 ORIGIN J. HAMILTON and wife, ROBIN E. HAMILTON did convey in trust certain land therein described to secure a Promissory Note duly incorporated in said Trust Deed by reference and said Trust Deed was duly recorded in the Register's Office of Polk County, Tennessee, in Trust Book 330, page 45;
