This is to inform Ann Voyles that you have 30 days from the first date of this notice in the Polk County News to remove your trailer.


TRUSTEE'S SALE


Sale at public auction will be on June 11, 2008, at 10:00 a.m., local time, at the west door, Polk County Courthouse, Benton, Tennessee pursuant to Deed of Trust executed by Jimmy R. Flowers and wife, Melinda Flowers to Emmett James House or Bill R. TRUSTEE'S SALE

 

WHEREAS, by Trust Deed dated the 1st day of December, 2005 ORIGIN J. HAMILTON and wife, ROBIN E. HAMILTON did convey in trust certain land therein described to secure a Promissory Note duly incorporated in said Trust Deed by reference and said Trust Deed was duly recorded in the Register's Office of Polk County, Tennessee, in Trust Book 330, page 45;

WHEREAS, J. Michael Sharp was appointed Substitute Trustee by instrument of record in MS _______, page _________;

WHEREAS, said Trust Deed provides that in the event of the default in the payment of any installment of said Note for a period of thirty (30) days, the entire indebtedness shall, at the option of the owner and holder thereof, become due and payable; and

WHEREAS, default has been made in the payment thereof and the owner and holder of said Note has declared the entire balance thereof due and payable and has instructed the undersigned  Trustee to foreclose said Trust Deed.

BEING LOT ONE (1) in the RICKY HUTSON SUBDIVISION a plat of which is recorded in the Register’s Office of for said  county in Plat book 8, page _____.  Said Lot is more particularly described as BEGINNING in the Northwest line of Old Ocoee Road where the same is intersected by the Northeast corner of land of Enriques (as recorded in DB 72, page 134); and from said beginning point and run with said line of said Road, North 23° 25’ 53” East, 22.58 feet to a slight angle; thence continuing on with said line of said Road, North 19° 15’ 05” East, 67.35 feet; thence with the Southwest line of Lot 3 as shown on said Plat, North 63° 59’ 02” West, 344.54 feet to corner; thence with the Southeast line of said Lot 3, South 19° 56’ 54” West, 89.95 feet to the Northeast line of said Enriques; thence following said line of said Enriques, South 63° 58’ 52” East, 343.2 feet to the beginning.  Description taken from recorded plat.

Also conveyed herewith is a non-exclusive and perpetual right of way easement being located between Lots 1 and 2 as shown on said recorded Plat and being a strip 30-foot wide and approximately 344.54 feet in length.  However all parties who use said right of way easement shall share pro rata in the cost of upkeep and maintenance.

SUBJECT to any and all governmental zoning and/or subdivision regulations or ordinances in effect thereon.

Being the property conveyed to Origin J. Hamilton and wife, Robin E. Hamilton by deed of record in DB 242, page 34, ROPCT.

The street addresses are believed to be 499 Reynolds Bridge Road, Ocoee, TN 37361.
